Аннотация
Обеспечение духовной безопасности граждан страны является приоритетным направлением государственно-конфессиональной политики. Религиоведческая экспертиза является одним из эффективных инструментов в борьбе с распространением экстремистских идей и противоправного контента. В статье проанализирован правовой статус заключения религиоведческой экспертизы в Казахстане и механизмы обеспечения его качества. Особое внимание уделяется проблеме соотношения научной природы экспертного заключения и его практического влияния на принятие административных решений. Исследование основано на формально-юридическом, системном, функциональном и сравнительно-правовом методах. Проведен анализ практики организации религиоведческой экспертизы в России, Кыргызстане, Узбекистане и Азербайджане с целью выявления элементов, которые могут быть адаптированы к отечественным механизмам. Авторы приходят к выводу, что действующее законодательство позволяет разграничить правовую природу заключения религиоведческой экспертизы, уведомительного письма, посредством которого оно доводится до сведения заявителя, и административного акта, принимаемого уполномоченным органом с учетом выводов экспертизы. Рекомендательный статус заключения должен сохраняться, однако его влияние на административное решение требует проверяемых гарантий качества. В связи с этим авторы предлагают трехуровневую модель: единый стандарт обоснования заключения, независимое научное рецензирование сложных дел с существенными правовыми последствиями, системное развитие и оценка компетенции эксперта. Предлагается апробировать механизмы в пилотном режиме, а затем закрепить эффективные элементы в законодательных актах.
